Mobile Terms of Service

WESTERN STONE & METAL CORP. dba Shane Co., its subsidiaries and affiliates (collectively, “Shane Co.,” “we,” “us” or “our”) offers a mobile messaging program (“Program”) that provides transactional alerts (such as order updates) and promotional text messages (such as offers, product launches, and events) to customers who opt in. Participation in the Program is subject to these Mobile Terms of Service (“Mobile Terms”), our general Terms and Conditions (https://www.shaneco.com/about/terms-and-conditions) and our Privacy Notice and Cookie Policy (https://www.shaneco.com/about/privacy-policy).

By opting in to our SMS Program, you agree to receive recurring SMS/text messages from or on behalf of Shane Co. via automated means – for both transactional and marketing/promotional purposes – and you accept and agree to these Mobile Terms.


When you opt in to our SMS program, you likewise understand and agree that our full Terms and Conditions and Privacy Notice (linked above) are incorporated into and become part of these Mobile Terms. NOTE THAT THE TERMS AND CONDITIONS AND PRIVACY NOTICE CONTAIN AN ARBITRATION AGREEMENT, LIMITATIONS ON OUR LIABILITY, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS REGARDING THE SMS PROGRAM. PLEASE CAREFULLY READ AND UNDERSTAND ALL TERMS.

1. Program Description

 

The Program may include both transactional messages (e.g., order and delivery updates, restock notifications) and marketing/promotional messages (e.g., sales alerts, special offers, product launches, and event invitations). Messages may be sent using an automatic telephone dialing system or other technology.

 

Note also that our Program features a cart abandonment messaging feature. As part of your opt-in (described below), you will have explicitly opted in to this feature. If you have opted in, the Program provides alerts, information, promotions, specials and other marketing offers (e.g., cart reminders) from Shane Co.

 

Message frequency may vary. Consent to receive marketing messages is not a condition of purchase.


2. Opt-In

 

You may opt in to the Program by:

 

  • Entering your mobile number at checkout or on our website form
  •  

  • Texting a keyword to our short code 56546
  •  

  • Checking an opt-in box (if applicable) with language indicating your agreement to receive messages

 

By opting in, you authorize us to send SMS/text messages using an autodialer or similar technology, as permitted under the Telephone Consumer Protection Act (TCPA). Note that if you have entered your mobile # on our website and clicked “Sign Me Up” where it indicates you will be enrolled in marketing texts, or if you have texted “FRIEND” to our SMS number then you will have agreed to receive autodialed SMS and other marketing messages per month from us on your mobile #. Message frequency varies.

 

3. Opt-Out

 

You may opt out of the Program at any time by texting STOP to 56546, or call (866) 467-4263. If you opt out, you will receive 1 final text message confirming your decision to unsubscribe and information on how to re-subscribe if you change your mind. After that, you will no longer receive messages unless you opt back in. You will receive a confirmation text that you have been unsubscribed. After that, you will no longer receive messages unless you opt back in.

If you opt out, you will receive 1 final text message confirming your decision to unsubscribe and information on how to re-subscribe if you change your mind. Texting STOP will only opt out of receiving SMS messages not other types of marketing communications, ex. Email or direct mail. Please call (866) 467-4263 to opt out of all marketing communications.

 

4. Message & Data Rates

 

Message and data rates may apply. Check with your wireless carrier for details regarding your individual plan.

5. Carrier Disclaimer

 

Wireless carriers are not responsible for delayed or undelivered messages. SMS may not be delivered to you if your phone is not in the range of a transmission site, or if sufficient network capacity is not available at a particular time. Carriers are not liable for delayed or undelivered messages. Even within coverage, factors beyond the control of the participating carriers may interfere with messages delivery for which the carrier is not responsible.

6. Privacy and Data Use

 

We value your privacy. For details on how we collect, use, and share personal information, please refer to our Privacy Notice (https://www.shaneco.com/about/privacy-policy). Depending on your place of residence and other factors you may have various other rights applicable to these Mobile Terms and the subject matter of the same. We highly encourage you to read the Privacy Policy and exercise your rights described therein should you feel it desirable. Except as may otherwise be described in our Privacy Notice, we do not sell your mobile phone number or use your information for purposes other than delivering SMS communications related to your relationship with Shane Co.

7. Eligibility

 

The Program is intended for U.S. residents aged 13 or older. If you are under 18, you must have permission from a parent or legal guardian. SMS offers and communications may only be accessible on smartphone devices.

8. Modifications

 

We may modify these Mobile Terms at any time. Continued participation in the Program after such changes constitutes your acceptance of the new Mobile Terms.
